MINUTES
ZONING BOARD OF ADJUSTMENT
SUNAPEE, NH
NOVEMBER 16, 2005
MEMBERS PRESENT: PETER WHITE, CHAIRMAN , JAMES LYONS VICE CHAIRMAN, JAMES LYONS AND ALTERNATES, DON WEATHERSON AND RICHARD GUYER AND ROGER LANDRY, ZONING ADMINISTRATOR.
The meeting was called to order at 7:00 P.M. by Chairman, Peter White.
Don Weatherson was absent . Robert Henry was designated to vote in his place.
MINUTES : The minutes of November 10 were reviewed. James Lyons requested that one sentence be added to correct the minutes. The minutes will be signed at the nest meeting. Peter Urbach made a motion to approve the minutes with one correction. James Lyons seconded the motion. There were five yes votes.
PLANNING BOARD REPORT: Roger reported that the Woodbine cottage property plan has been dropped. The Matt Girard conceptional hearing was held. A 4 lot Sub-division on Nutting Rd. was discussed. .
All members will be present at the December 8th meeting.
PUBLIC HEARINGS: 7:15 P.M. The meeting was held to discuss whether or not there would be a rehearing on Richard Bascom’s Cases # 05-26 and 05-40. Lee P. and David N. Page are appealing the cases. Richard Bascom has a copy of the November 14th letter from Atty Bates. Atty. Raymond and Mr. Page were also given copies of the letter. Atty Raymond wanted to discuss Case #05-40 first. This was a Special Exception. After the discussion. a motion was made by James Lyons to rehear Case #05-40 for a Special Exception . Art. III. 3:50 C. Reduce the side setbacks to 15’ and 12’ 6 “ for new construction at Map #121. Lot # 27. West Shore Rd Peter Urbach seconded the motion.There were five yes votes. The case will be reheard January 12, 2006. It Will be first on the
agenda of public hearings.
The next discussion was concerning Case #05-26 request for a Variance .Art. III. 3:10 to reduce the road front setback to 30’ for new construction Map # 121. Lot #27. West Shore Rd. Sunapee. Atty.Raymond felt that the Board did not address all five points of the requirements for a variance adequately. He felt that this is why he believes his clients are entitled to another hearing.
He was concerned that the issue of Public Interest was not covered to his satisfaction. He also voiced that each one of the requirements needed a vote. He also mentioned that the Lake Shore Overlay was not discussed.

It is expected that all of these concerns will be brought up at a rehearing. The Boaard members agreed to rehear the case. Richard Guyer made a motion to grant a rehearing on Case #05-26. Map #121. Lot #27 for a Variance. Art. III. 3:10 to Richard Bascom to reduce the roadfront setback to 30’ for new construction . 27 West Shore Rd. Sunapee. Robert Henry seconded the motion. There were five yes votes. This case will be the second case on the January 12, 2006 agenda.
Richard Guyer made a motion to adjourn the meeting at 8:15 P.M Robert Henry seconded the motion. All were in favor.
